The ABA has recognized the third week in October as Mediation Week to educate lawyers, dispute resolution professionals, students, and the public about mediation and related forms of collaborative problem solving.  During Mediation Week the ABA encourages all to recognize the importance of the work of neutrals, advocates and policy makers, while also celebrating the increasing diversity in the field and the growing use of mediation in the international community.

This event is an excellent networking and learning opportunity for attorneys, mediators and other ADR professionals, law students and corporate and government representatives.  There is no fee for attending the event.

Adoption Process | Permanency Mediation

Dusten Brown and his wife agree with Matt and Melanie Capobianco to use mediation to determine the best interests of daughter Veronica.  Even though the two couples are fighting over custody of Veronica, they agree on one thing, mediation.

After the biological mother placed the child for adoption, Veronica was placed with a South Carolina couple who raised her until she was two.  Prior to finalizing the adoption process, the biological father, a member of the Cherokee Nation, came forward.  He has cared for Veronica since 2011.

The case has been litigated in the state courts and tribal courts.  The U.S. Supreme Court determined the Indian Child Welfare Act did not apply.  The matter remains unresolved.  The South Carolina court gave custody to the Capobiancos and the Cherokee Nation court gave custody to Mr. Brown.

Hopefully by coming together in mediation the interested adults can utilize a child-centered approach to develop a permanent plan that provides for Veronica’s best interest.

Permanency mediation is a specific type of mediation utilized in adoption cases.  Mediators at Parker Mediation have completed specialized training and are experienced in permanency mediation.

Gun violence following mediation

Mediation is usually a place where conflict is resolved.   We are saddened to hear that three people are dead after a man shot a corporate attorney and his client following a mediation session Wednesday in Phoenix.  The man, who later committed suicide, was allegedly  litigious and had anger-management issues.

Dr. Viktor Frankl, who wrote ”Man’s Search for Meaning,” promoted the theory that the search for value and meaning in the circumstances of one’s life was the key to psychological well-being.  He suggested that despair can be overcome by discovering meaning in life, which in turn provides the will and strength to endure difficult times.   He shared that no matter what, where or how, we retain, ”the last of the human freedoms, to choose one’s attitude in any given set of circumstances, to choose one’s own way.”

Please choose peace, do not be discouraged by setbacks or failure, and don’t be afraid to use mediation to resolve conflict.



Can Mediators Help Save the Planet?

This past summer I attended a Two-Day Advanced Workshop with master mediator and collaborative negotiator Kenneth Cloke, J.D.  The workshop focused on advanced skills, including facilitating collaborative negotiations; managing difficult behaviors; overcoming impasse; helping clients learn successful approaches to conflict management; and designing settlements that plan for the future.  The quality of the program, the effectiveness of the presenter, the coverage of the subject and overall quality of the training provided a great benefit to me and my practice at Parker Mediation.   

Kenneth Cloke is the co-founder of Mediators Beyond Borders. Determining the Best Interests of Adolescent Children

          Teenage children sometimes become confused and present with difficult behavior. Parenting that previously worked may no longer manage difficult behaviors. During divorce, strategies that once helped seem to make things worse. Parenting through divorce presents unique challenges and concerns. Professionals can provide helpful information when co-parenting seems impossible.

          Courts are often ill equipped to make important parenting decisions about adolescents. Some teenage children get what they want, even in cases where a professional Guardian Ad Litem makes specific recommendations. This may results in dramatic changes for a child who is undergoing multiple changes due to parental divorce and adolescence. Parents may better explore and understand the best interests of their child when mediators provide education and resources.

          Research in the area of development psychology is relevant to understanding what is in the best interests of our teenagers. Participants in mediation each share their belief systems about what is best for the adolescent in regards to parenting and living arrangements. Learning how to manage parental conflict, to minimize the harmful effects on the adolescent child, is a big factor in the child’s future success. Families struggling with adolescent issues will find better resolutions using mediation.         

          There will always be conflict; learning skills to manage opposition is a worthy task for all parents. Differences of opinion arise whether couples remain married or parent post-divorce. Finding solutions together provides a less stressful atmosphere for the child and the parents.

Conflict Resolution Experts To Gather In Atlanta

The Association for Conflict Resolution (ACR) will hold its 9th annual conference in Atlanta, GA October 7-9, 2009.  Approximately 1,000 conflict resolution practitioners will attend this years event.  Some of the fields most highly regarded professionals will speak  about topics ranging from “Mediation of a parenting dispute with a Gay parent” to “Advance mediation techniques to move beyond the impasse“.
